Information provided to Debtors Interested in Attending and Participating in the Instructional Course Concerning Personal Financial Management
(Debtor Education)
Section 1328(g)(1) of the Bankruptcy Code states that the court shall not grant a discharge under this section to a debtor unless after filing a petition the debtor has completed an instructional course concerning Personal Financial Management (also known as Debtor Education).
If you are a Debtor and you are unable to attend the course or to complete the above requirement because of incapacity, disability, or active military duty in a military combat zone, you must contact your attorney to file the appropriate pleadings.
The United States Trustee Program has a list of approved providers of the financial management instructional course for bankruptcy filers. Please contact your attorney or check the Program’s website at www.usdoj/gov/ust.
The Dayton Chapter 13 Trustee’s Office is providing the Financial Management instructional course at NO CHARGE for Chapter 13 debtors.
The course is being taught by the Chapter 13 Trustee who has been a bankruptcy attorney for 21 years and has taught 10 years at the college level. Further, the Trustee has taught previously in a Debtor Education Program.
The Financial Management Instructional Course (Debtor Education) is being offered to Chapter 13 debtors as a two hour program on the Tuesday that the Chapter 13 Trustee’s Office is conducting your Meetings of Creditors in Room 309 in the U.S. Bankruptcy Courthouse, located at 120 W. Third Street, Dayton, Ohio 45402. The Debtor Education course will also be offered one Saturday per month. The Meeting of Creditors’ examinations are scheduled for the morning and afternoon, and will not interfere with the Debtor Education course. Note that the Debtor Education course will be taught in a different location than your Meeting of Creditors. The Office of the Chapter 13 Trustee is located two blocks north from the U.S. Bankruptcy Courthouse.
The Personal Financial Management program will be held in the Conference Room at the Office of the Chapter 13 Trustee, 131 N. Ludlow Street, 9th floor of Talbott Tower, Dayton, Ohio 45402. There is a map attached. The phone number for the Debtor Education Coordinator (John Haber) is 937-222-7600, extension 112. Please call to reserve a spot for your attendance in the program.
Upon completion of the course, the Office of the Chapter 13 Trustee will provide a “Debtor’s Certificate of Completion of Instructional Course Concerning Personal Financial Management” to the debtor and mark their attendance in our system to allow a discharge upon the completion of the debtors’ Chapter 13 plan.

Agreement to Disclose Information to Debtor Students
The Chapter 13 trustee is pleased and proud to present a Financial Management course to you. The trustee has long believed that education is the key to financial success. The materials and workbook provided to you are periodically updated to insure that both current and relevant information is presented to you. The purpose of this course is to educate and empower you in order that you can make better financial/consumer decisions in the future. In addition, completing the Pre-Discharge requirements of the newly implemented BAPCA law.
The Provider does not pay or receive fees or other consideration for referral of debtor students to or by the Provider. This course is offered to you at no cost other than the Trustee fee which is collected for the administration of your repayment plan. Therefore, the course offered to Debtor students without regard to the ability to pay.
The teachers of this course are the Chapter 13 Trustee and several of his staff members. The Chapter 13 Trustee has taught for 10 years in a classroom environment and 5 years in Consumer Credit Education. The staff members include his Staff Attorney, Operations Manager, and Debtor Education Coordinator. All which have either a JD Degree or a BSBA Degree. The staff members have 19 years combined classroom teaching experience.
The course is being offered at the Office of the Chapter 13 Trustee. The office is located at 131 N. Ludlow St, Dayton, OH 45402. Classes are offered every Tuesday 11:15 – 1:15 in between the meeting of Creditors, and once a month on Saturdays 10:00 – 12:00. Upon arrival at the course, you are required to show your picture I.D. and sign in for identification purposes. Upon conclusion of the course, you will receive a Certificate of Completion, which will also be E-mailed to your Attorney. We will also note your attendance in our system. You will also be requested to complete a course Evaluation form and sign out.

DEBTOR EDUCATION COURSE
You are now required by the new legislation to attend and participate in an Instructional Course Concerning Personal Financial Management. This course is also known as Debtor Education. You must complete this course prior to your last payment in your Chapter 13 plan in order to receive a Discharge in Chapter 13.
The Dayton Chapter 13 Trustee’s Office is offering the Course free of charge on the day of your Meeting of Creditors, which Meeting you are required to attend. This is the first date on your “Notice of Chapter 13 Bankruptcy Case, Meeting of Creditors, and Deadlines”. Talk this over with your attorney.
